Welcome to the Tshura website. The following terms and conditions govern the use of the website and the terms of purchase on it. Use of the website, browsing it, and making purchases constitute full agreement to the terms detailed here. Please read them carefully before placing an order.
The regulations are written in the masculine gender for convenience purposes only, and they refer to all genders equally.
General
1.1 Teshuva Website (hereinafter "the Website") is an online store selling handmade Jerusalem stone Judaica and home decor products, including mezuzahs, candlesticks, menorahs, challah and serving platters, clocks, signs, and home decor products.
1.2 The site is operated by Tshura, at www.tshura.co.il (hereinafter "Tshura" or "the Company").
1.3 The Company may update the Terms and Conditions from time to time, at its sole discretion. The updated version will be binding from the moment it is published on the website. It is recommended to review the Terms and Conditions before each purchase.
1.4 Wherever there is a contradiction between the regulations and another publication on the site, the regulations shall prevail, unless otherwise expressly stated.
2. Settings
"User" or "Customer": Any person browsing the website or performing any action on it, including a purchase.
"Product": Any item offered for sale on the website.
"Order": A purchase request made by the customer through the website.
3. Kosher for use
3.1 Use of the website and making purchases are permitted for users aged 18 and over, who have the legal capacity to enter into an agreement, and who possess a valid payment method.
3.2 A user under 18 years of age may only make a purchase with the approval of a parent or guardian.
3.3 Placing an order constitutes a declaration by the customer that they meet these terms and that the details provided are correct and accurate.
4. The Products
4.1 The products on the website are handmade from Jerusalem stone. Natural variations in the stone's hue, texture, and grain are a natural result of the raw material and the handmade process. These variations are a characteristic of the product and are not considered defects.
4.2 Slight differences may occur between the product received and the image displayed on the website, due to reasons including display differences on various screens and the unique nature of each handmade item.
4.3 The images on the website are for illustrative purposes only. Tshura makes every effort to display products as accurately as possible.
4.4 Tshura does not guarantee to keep all products in stock at all times. In the event that a product is out of stock after an order has been placed, Tshura will contact the customer to coordinate further treatment, including a full refund for the out-of-stock product.
5. Pricing and Payment
5.1 Prices on the website are quoted in New Israeli Shekels.
5.2 Tshura operates as a VAT-exempt dealer and does not charge Value Added Tax.
5.3 Shipping fees are not included in the product price and will be added at checkout according to the shipping policy.
5.4 Payment is made by credit cards and other payment methods, as will appear on the payment page.
5.5 Tshura may update product prices and shipping fees from time to time. The binding price is the price displayed to the customer upon completion of the order.
6. Placing and confirming an order
6.1 After completing the order, the customer will receive a confirmation message, and an order confirmation will be sent to the email address they provided.
6.2 Order fulfillment is subject to authorization by the payment processor and product availability. The order will only be considered complete after payment authorization.
6.3 Teshuva may, at its discretion and for reasonable grounds, refuse to approve an order. This may occur, among other reasons, in cases of suspected illegal activity, incorrect details, or payment authorization failure. In such an event, no payment will be charged, and if payment has been charged, it will be refunded to the customer.
7. Supply and Shipping
7.1 The supply of products is carried out in accordance with the website's shipping policy, which is an integral part of these terms and conditions.

8. Cancellation, Refunds, and Returns
8.1 Transaction cancellation shall be made in accordance with the provisions of the Consumer Protection Law, 5741-1981, and the Consumer Protection (Cancellation of Transactions) Regulations, 5771-2010.
8.2 The customer may cancel the transaction from the moment the order is placed until 14 days from the date of receipt of the product.
8.3 A cancellation notice will be sent to the Lessee via the contact details appearing in these regulations.
8.4 In the event of a cancellation not due to a defect or nonconformity, Tshura may charge a cancellation fee not exceeding 5% of the product’s price or 100 New Shekels, whichever is lower. The customer is responsible for returning the product to Tshura at their own expense, unless otherwise provided by law.
8.5 The refund will be processed within 14 days of receiving the cancellation notice, using the same payment method as the original transaction, subject to the product being returned in good, unused condition.
8.6 Pursuant to Section 14(C)(d) of the Consumer Protection Law, the right of cancellation does not apply to products manufactured specifically for the customer following the transaction or customized for them, including products with personal engraving, dedication, name, special dimensions, or design at the customer's request. Cancellation of a transaction for such products is only possible in case of a defect or non-conformity.

9. Intellectual Property
9.1 All intellectual property rights on the website, including the brand name Tshura, the logo, the slogan, the design, the images, the texts, and the content, are the exclusive property of Tshura and are protected by law.
9.2 You may not copy, reproduce, distribute, publish, or make any commercial use of the website's content, in whole or in part, without prior written approval from "Tshura".
10. Warranty and Limitation of Liability
10.1 Tshura acts to ensure the quality of its products and to present accurate information on the website. However, Tshura is not responsible for any indirect, consequential, or special damages caused to the customer or any third party as a result of the use of the website or products, beyond its statutory obligations.
10.2 The use of products is the responsibility of the customer and in accordance with their intended purpose. Handmade stone products require proper care and maintenance to preserve their appearance over time.
10.3 The foregoing shall not derogate from the customer's rights under the Consumer Protection Law and any other protective law.
11. Privacy
The use of the site is also subject to the Privacy Policy of Tshura, which is an integral part of these terms and conditions and details how users' personal information is collected, stored, and processed.
12. Variance
12.1 This policy and any use of the website shall be governed solely by the laws of the State of Israel.
12.2 Exclusive jurisdiction over any dispute concerning the terms or use of the site shall be vested in the competent courts in the State of Israel.
12.3 If a provision of the By-laws is determined to be invalid, this shall not affect the validity of the remaining provisions.
